Immanuel Kant defines virtue as a kind of strength and resoluteness of will to resist and overcome any obstacles that oppose fulfilling our moral duties. Human agents, according to Kant, owe it to ourselves to strive for perfect virtue by fully committing ourselves to morality and by developing the fortitude to maintain and execute this life-governing policy despite obstacles we may face. This essay reviews basic features of Kant’s conception of virtue and then discusses the role of emotions, a motive (...) of duty, exemplars, rules, and community in a virtuous life. Kant thinks that striving to be more virtuous requires not only respect for moral principles and control of our contrary emotions but also a system of legally enforced rules and communities of good persons. Exemplars and cultivated good feelings and emotions can also be useful aids along the way, but Kant warns us against attempting to derive our moral standards themselves from examples or feelings. The best any of us can hope for, in Kant’s view, is to make constant progress in our difficult struggle for moral perfection. (shrink)

ObjectivesTo describe reporting of informed consent in pragmatic trials, justifications for waivers of consent and reporting of alternative approaches to standard written consent. To identify factors associated with (1) not reporting and (2) not obtaining consent.MethodsSurvey of primary trial reports, published 2014–2019, identified using an electronic search filter for pragmatic trials implemented in MEDLINE, and registered in ClinicalTrials.gov.ResultsAmong 1988 trials, 132 (6.6%) did not include a statement about participant consent, 1691 (85.0%) reported consent had been obtained, 139 (7.0%) reported a (...) waiver and 26 (1.3%) reported consent for one aspect (eg, data collection) but a waiver for another (eg, intervention). Of the 165 trials reporting a waiver, 76 (46.1%) provided a justification. Few (53, 2.9%) explicitly reported use of alternative approaches to consent. In multivariable logistic regression analyses, lower journal impact factor (p=0.001) and cluster randomisation (p<0.0001) were significantly associated with not reporting on consent, while trial recency, cluster randomisation, higher-income country settings, health services research and explicit labelling as pragmatic were significantly associated with not obtaining consent (all p<0.0001).DiscussionNot obtaining consent seems to be increasing and is associated with the use of cluster randomisation and pragmatic aims, but neither cluster randomisation nor pragmatism are currently accepted justifications for waivers of consent. Rather than considering either standard written informed consent or waivers of consent, researchers and research ethics committees could consider alternative consent approaches that may facilitate the conduct of pragmatic trials while preserving patient autonomy and the public’s trust in research. Let me attempt a drastic summary, or symbolic reduction, of Mr. Foss's adeptly metaphorical exposition. The use of the copula is, implicit in the appositive series, will do some violence to the complexity of the argument, but since causes and parts are frowned on by the same argument, the simpler arrangement cannot be altogether out of keeping. In logical and grammatical terms, we have on two sides of a profound ledger: "symbolic reduction," the divisive subject and predicate,--and "metaphoric process," the (...) underlying and unifying energy of the proposition, the subjectum. The negations of dialectic operate to show the insufficiency of symbolic concepts and are the "door to philosophic truth." And in ontological terms, we have on the one hand number, time, space, cause and effect, coincidence and contingency; and on the other the different, the naught, the apeiron, the potential, the tension of process, freedom and necessity in metaphoric lawful unity. There are two closely similar extremes of reduction between which one locates the transcendent philosophy of metaphor: that of sensationalism, the philosophy of the brute and atomic, and that of rationalism, the philosophy of expedient action. And in more or less theological terms, we have on the one hand the environment and its complement the ego, purposive and possessive; on the other, World, the I and the Thou, prayer, sin and grace in the metaphorical unity of consciousness, the widening power of personality in intercession or metaphorical representation. On the one hand, birth and death, past and future, and a present extending ad libitum into either; on the other, the eternal present of the integrated process stretching over past and future, expressed in its purest form in art. And so in aesthetic terms: on the one hand catharsis, a rationalized mixture of the ego's pleasure and pain, asceticism and hedonism, play; on the other, drama--especially tragedy, which par excellence action--Eudaimonia, purification, artistic distance, stylization, imagination, conscience, love. On the one hand, comedy in the sense of farce, environment symbolically reduced, actions and persons according to type, the mechanism of means and ends, rules, rituals, tricks, chance, the caricature of symbolic fixation--producing laughter: on the other hand, true and great comedy, the attempt to understand life in all its contradictions, producing the smile. In the analysis of Aquinas, instrumental causation is central to his doctrine of providence, yet their connection is not widely understood. On the one hand, early modern thinkers like Nicolas Malebranche claim that any notion of instrumental causation is unintelligible as a mode of divine operation. Alternatively, certain Thomists commit Aquinas to the doctrine of premotion, which partially resolves the problem of instrumental causation, but only at the cost of eliminating the causal freedom of creatures. In this paper I address (...) these two issues. After providing an outline of Aquinas’s position on instrumental causation, I first argue that Thomistic instrumentalism is not the target of Malebranche’s objections, for Malebranche endorses a view very much like that of Aquinas. Secondly, I discuss the doctrine of premotion and offer some reasons for thinking that Aquinas was not a premotionist. (shrink)

I attempt to describe and defend an alternative definition of insanity. I claim that my definition follows from an adequate general understanding of legal excuse and that it describes correctly the question that jurors in the recent Andrea Yates case and others like it ought to be faced with. My essay has three parts. In the first, I briefly criticize M'Naghten- and Durham-inspired insanity statutes. In the second, I sketch and defend a general understanding of legal excuse and try to (...) show how an adequate insanity statute follows from it. Finally, in the third section, I describe and defend a rough version of the statute itself. In the course of doing so, I try to explain why I believe that statute is superior to the American Law Institute's various model insanity statutes. (shrink)

Gadamer's book extends and codifies the main hermeneutical concepts of Bultmann, Heidegger, and their adherents, and can be considered a summa of what Robinson calls "The New Hermeneutic." By Robinson and other theologians, and by Continental literary critics, Wahrheit und Methode has been welcomed as a philosophical justification for "vital and relevant" interpretations that are unencumbered by a concern for the author's original intention. On this point "The New Hermeneutic" reveals its affinities with "The New Criticism" and the newer "Myth (...) Criticism." All three have impugned the author's prerogative to be the determiner of textual meaning. Gadamer, however, grounds his anti-intentionalism only partially in aesthetics and not at all in the collective unconscious but primarily in the radical historicism of Martin Heidegger. (shrink)

Hurricane Katrina offered a revealing snapshot of the historical vulnerability that New Orleans and Gulf Coast residents have long experienced and continue to face. In particular, population groups with special health needs—those suffering from debilitating chronic diseases—were among those most at risk during the storm. Focusing specifically on diabetic evacuees during and after Katrina, this essay examines how the lack of planning during the disaster led to diminished access to dialysis as well as poor food and inadequate insulin management in (...) evacuation shelters. In so doing, it underscores the strong links between disasters and public health concerns such as elevated risks for complications, emergency room visits, hospitalizations, and reduced life expectancy for individuals with diabetes. As the case of Katrina powerfully illustrates, populations suffering from chronic diseases like diabetes suffer disproportionately from disasters and other disruptive events. (shrink)

Others may charge this equivalence as hyperbole, but the numbers betray a system of racialized injustice that people of good will ought to reject today as did like-willed people of the churches, synagogues, and community organizations of the years leading up to the civil rights movement and beyond. This essay exposes the factors of (...) race and poverty that lead to determinations of the guilt or innocence and the likelihood of a death or life sentence to those convicted of capital crimes. This study examined audience perceptions of a political candidate’s credibility and likeability as a function of varying the candidate’s responses to an opponent’s nonverbal disparagement during a televised debate. 412 participants watched a purported televised debate between candidates for mayor in a small city in Utah. In all six versions, one debater engaged in strong nonverbal disagreement during his opponent’s opening statement. His opponent responded to the nonverbal behavior with one of six decreasingly polite messages. Results indicated that more direct (...) messages increased audience perceptions of the speaker’s expertise and character compared to providing no response. The results also showed a significant interaction between response type and audience member’s level of trait verbal aggressiveness. The “indirect” and “on-record with redress” responses led to stronger perceptions of speaker composure and extroversion for members high in verbal aggression and the “off the record” strategy led to higher perceptions of extroversion and composure for members low in verbal aggression. Nor does any one violate a collective action version of the rescue principle when she makes a frivolous purchase instead of giving to a charity. Garrett Cullity is also mistaken in believing that ‘the transitivity of wrongness’ can be used to reach the conclusion that a failure to give to charity is wrong (...) because a failure to save is. This makes it likely that the requirement to give to charity is based not on the requirement to rescue but instead on the moral requirement to marginally improve the ability of charitable organisations to do their important work. [The Historical Roots of Our Environmental Crisis; ].

I argue in this paper that philosophers have tended to neglect most autobiographies, even explicitly philosophical ones, due to invalid presuppositions about genre demarcations, and that they would do well to consider them for the resources they offer in terms of constituting positions on selfhood and agency. I further argue that Jacques Derrida offers a productive theoretical framework for understanding philosophical autobiographies as performances, or instances of "making" the truth (Augustine's veritatem facere) by "testifying" or "witnessing," and analyze both Derrida's (...) "Circumfession" and Søren Kierkegaard's 'On My Work as an Author' as examples of this kind of performance. (shrink)

"Uprightness" was termed the "leitmotiv in the formation of the human organism" by Erwin Straus (1966, p. 139). He felt that without it the human being was certainly doomed to die. Yet, what happens with those who are deprived of their "uprightness" in either the literal or moral sense (as in "not to stoop to anything"), through becoming Dis-abled? Getting up, rising in opposition to the "other" (Allon) implies a moral dimension in the case of human Dis-ability which is tied (...) to the leitmotiv established by the upright posture of anthropos . The suggestion that there is a moral dimension to Disability is a radical notion in a culture whose health professionals have become very sensitive to any idea that suggests we are blaming those who through no fault of their own have become in some way disadvantaged as compared to the mainstream of society. Although the importance of rising in opposition to the world (Allon) was perhaps originally established upon the upright posture quite literally, because man is a sense-making and sense-giving creature, this primordial act which establishes our full humanity may itself be represented and re-enacted in a variety of ways which can and should become the central project of rehabilitation of the body, as opposed to the current emphasis on technique and technological innovation. It is in the changing physiognomy of the Dis-abled person's ruptured world that we may discover the phenomenological sense of Dis-ability.
